1Acceptance of Terms
By downloading, installing, or using the WhereWas mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2Description of Service
WhereWas is a photo location guessing game that accesses your photo library to read location metadata from your photos. The App provides both free and premium subscription features to enhance your gaming experience.
3Subscription Services
3.1 Premium Subscription
- •WhereWas offers monthly premium subscriptions through the App Store
- •Subscription provides access to premium features, unlimited gameplay, advanced statistics, and an ad-free experience
- •Pricing is displayed in the App and may vary by region
3.2 Auto-Renewal
- •Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- •Your App Store account will be charged for renewal within 24 hours prior to the end of the current period
- •The cost of renewal will be the same as the original subscription price unless otherwise communicated
3.3 Managing Subscriptions
- •You can manage and cancel your subscription through your App Store account settings
- •Cancellation takes effect at the end of the current billing period
- •No refunds will be provided for unused portions of subscription periods
3.4 Free Trial
- •We may offer free trial periods for premium subscriptions
- •You may cancel during the trial period to avoid charges
- •If you don't cancel during the trial, you will be charged the subscription fee
4User Accounts
4.1 Account Creation
- •You may create an account using your email address
- •You are responsible for maintaining the confidentiality of your account credentials
- •You must provide accurate and complete information
4.2 Account Termination
- •We may suspend or terminate your account for violations of these Terms
- •You may delete your account at any time through the App settings
5Acceptable Use
You agree not to:

- ✕Attempt to reverse engineer, decompile, or disassemble the App

6Privacy and Data
Your privacy is important to us. Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our Privacy Policy.
7Photo Access and Usage
7.1 Photo Library Access
- •The App requires permission to access your photo library to read location metadata
- •Photos and location data are processed locally on your device
- •We do not store your actual photos or detailed location coordinates on our servers
7.2 User Content
- •You retain ownership of your photos and any content you create
- •By using the App, you grant us a limited license to process your photo metadata for gameplay purposes
- •You may opt out of sharing game results that could contain location information
8Intellectual Property
8.1 App Ownership
- •The App, including its design, code, and content, is owned by WhereWas and protected by intellectual property laws
- •These Terms grant you a limited, non-exclusive license to use the App for personal, non-commercial purposes
8.2 User Feedback
- •Any feedback, suggestions, or ideas you provide about the App become our property
- •We may use such feedback without compensation or attribution
9Disclaimers and Limitations
9.1 Service Availability
- •We strive to maintain App availability but do not guarantee uninterrupted service
- •We may temporarily suspend the App for maintenance, updates, or technical issues
9.2 Accuracy
- •Location-based gameplay relies on metadata from your photos
- •We cannot guarantee the accuracy of location data in your photo library
9.3 Limitation of Liability
To the maximum extent permitted by law, WhereWas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
10Indemnification
You agree to indemnify and hold harmless WhereWas from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
11App Store Terms
Your use of the App is also subject to the applicable App Store's terms and conditions. In case of conflict between these Terms and the App Store terms, the App Store terms shall prevail regarding the App Store relationship.
12Termination
We may terminate or suspend your access to the App immediately, without notice, for any breach of these Terms. Upon termination, your right to use the App ceases immediately.
13Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.
14Governing Law
These Terms are governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles.
15Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
